UK GDPR stands for the retained EU law version of the General Data Protection Regulation (EU) 2016/679.
The General Data Protection Regulation (now known as EU GDPR) was implemented on 25 May 2018. The EU GDPR was directly applicable in the UK until 31 January 2020 (Brexit), when the UK ceased to be member of the EU. Following an 11-month transition period that ended on 31 December 2020, the retained EU GDPR operates in domestic law under the new name the ‘UK GDPR’.
The UK GDPR came into effect on 1 January 2021.
The UK GDPR applies to all organisations and professional or commercial activity individuals who process the personal data of individuals within the United Kingdom regardless of where the organisation itself is based.
Is GDPR Training a Legal Requirement?
Yes
Article 39 of the UK GDPR states that an organisation’s data protection officer needs to ensure awareness-raising and training of staff involved in personal data processing operations, and the related audits.
Article 47 also states that there is a need for ‘appropriate data protection training to personnel having permanent or regular access to personal data.’
Under the heading of ‘Accountability and governance’, The Information Commissioner’s Office (ICO) – the UK supervisory authority who enforce UK GDPR, have also stated that:
"You must: implement appropriate technical and organisational measures that ensure and demonstrate that you comply. This may include internal data protection policies such as staff training, internal audits of processing activities, and reviews of internal HR policies."
